The Canadian government allows Canadian citizens and permanent residents who are in a relationship with a foreign national to sponsor that person to join them and become a permanent resident of Canada. Under its Immigration Levels Plan, Canada aims to welcome over 400,000 new immigrants per year. Among family class immigrants, Canada seeks to welcome some 80,000 per year under its Spouses, Partners, and Children category.

Application

Eligibiity

  • For Permanent Residents living outside Canada
    • Applicants need to return to Canada and live in Canada before sponsoring their partner & dependent children to apply for PR visa inside Canada
  • For Canadian Citizens living outside Canada
    • Applicants can sponsor their partner & dependent children to apply for PR visa outside Canada, if they demonstrate an intention to live in Canada when their family member becomes a PR
  • Same-gender marriage/common-law relationship
    • For common-law relationship, the couple must have lived for at least 12 consecutive months in a marriage-like relationship
    • For marriage taken place outside of Canada, it must be legally recognized in the country where it took place

To be qualified as dependent children, they must be

  • Single and under 22 years old
    • Children 22 or older qualify as dependents only if they have substantially financial depended on their parents since before attaining 22 and they are unable to be financially self-supporting due to a physical or mental condition

    • Your children’s age is locked once IRCC or provincial government receiving your complete application, so they won’t become ineligible no matter how long it takes to process it
